New Changes to Australian Immigration Visa in 2020 You Must Know

Recently, an article was published by the Australian Associated Press that stated migrants are permitted to live and work in Australia if they invest a minimum of $1.5 million or more. Now, the Morrison Government is planning to increase the investment thresholds for investment and business innovation visas. It is expected that investment in regional areas will be a prime priority. Also, the government intends to streamline the program, which presently includes nine visa streams and three visas.

New Regional Visas Announced with PR Pathways

2 new regional visas have been announced by the Australian government. Also, there have been changes made to the point test that came into operation from November 2019.

These two new regional or provisional visas are:

Subclass 494 Skilled Employer-Sponsored Visa – Replacing the 187 (RSMS) visa and commencing November 16, 2019, the 494 Visa has 10,000 places allocated per year. It needs employer sponsorship and the position is likely to continue for 5 years. This visa holds an age limit of 45 years (including exemptions), RCB advice, competent English and must meet the AMSR guidelines. The visa applicants must hold a suitable skill assessment on the 494 occupations list and a minimum of 3 years of skilled employment.

Subclass 491 Skilled Work Regional (Provisional) Visa – The new 491 visa is the Skilled Work Regional (Provisional) Visa subclass 491 will allow eligible skilled workers as well as their families to work, study, and live in designated regional Australian areas for 5 years. It makes visa holders eligible to apply for the Permanent Residence visa after three years. It is essential that applicants for this visa are nominated by:

A territory or state government agency of Australia (491) occupation list, or

Sponsored by an eligible member of the family from MLTSSL list living in designated regional areas and can be invited to apply for this visa, allowing submission of EOI or Express of Interest in Skill Select.

Subclass 191 Permanent Residence (Skilled Regional) – In order to meet the requisites of the permanent visa the applicants from November 2022 must hold subclass 494 or 491 visas for a minimum of 3 years, has compiled with the conditions on that visa and have successfully met minimum taxable income requisites.

Additional 1 or 2 Year Visa for International Graduates from Regional Institutions

A new initiative has been announced by the Department of Home Affairs for an additional Temporary Graduate visa with an additional one or two years of post-study work rights for the international students who:

Maintain an existing residence in a regional area while possessing their first Temporary Graduate subclass 485 visas.

Graduate from the Campus belonging to any Australian region of a registered institution or university with a postgraduate or higher education qualification.

The Temporary Graduate visa that needs ongoing residence in the regional area now includes Gold Coast and Perth as the regional areas.  Moreover, visa holders of new Regional provisional visa will be eligible for Medicare.

Global Talent – Independent Program (GTIS) and Employer-Sponsored Program (GTES)

It has also been announced by the Department of Home Affairs regarding the Global Talent Program Employer-Sponsored permanent to become part of the world’s promising and brightest Australian start-ups and businesses. The same will hold streamlined access to the best talent from across the world with the existence of the Global Talent – Employer-Sponsored Program, primarily the Global Talent Scheme.

This decision has been made by the government realizing that there is intense competition for high-tech talent and skills and that attracting such people aids to transfer skills to Australian workers and expand Australian-based businesses.

There will be two components included in the Global Talent Scheme:

Start-up stream

Established businesses holding a yearly turnover of more than $4 million

It has been announced by the Department that the Global Talent – Independent Program allows a well-defined and priority visa route for highly talented and skilled individuals to live and work permanently in the Australian country.

This is all well and good. But if you’re really wanting to study in Australia you’re going to need a student visa. Now student visas have a complicated set of requirements. And you’re going to have to tick them off if you want to get that coveted stamp of approval.

So how do you ace the visa test? Simple. You have to defend your visa. Protect it from rejection. Barricade it from denial. You need to follow the student visa process step-by-step.

And the only way you can do that is if you know what pitfalls to look out for. So, time to get familiar with the top 7 failures in visa applications, and how you can avoid them. Time to craft a visa that’s impervious to rejection.

1. FAILURE TO MEET THE GENUINE TEMPORARY ENTRANT REQUIREMENT
First things first. If you have no clear plan for your education in Australia, it’s time to get one. At least, if you want to show you are a genuine, one of a kind-ish, aspiring exchange student. We don’t want swindlers and wannabes.

In this case, one of your biggest visa requirements is to pass the GTE. Australia’s Genuine Temporary Entrant (GTE) requirement operates as an integrity measure. Its basic point is to ensure your student visa program is actually intended for study, as opposed to sneaking in a bit of ongoing residency in Australia.

The GTE test is a way for the government to siphon out applicants who are using the student visa program for motives ulterior to gaining a quality education in Australia. It’s a ‘Do you really care about learning’ kind of test.

As an applicant you need to show (provide documentary proof) that you are coming to Australia on a genuine pilgrimage for knowledge and wisdom. You will need to provide a personal statement (in English, Google translate will help you out) addressing the GTE requirements.

With your application you’ll need to attach a written statement along with supporting documents. If your statement is generic (don’t be boring) and doesn’t have documentary evidence, your application won’t fair too well on assessment.

Another factor that comes into play on the GTE is the personal circumstances of an applicant. This is assessed based on some of the following requirements:

Potential circumstances in Australia; level of knowledge of proposed course and education provider, previous study/qualifications, planned accommodation arrangements, and financial capacity.

2. FAILURE TO MEET ACADEMIC QUALIFICATION

Now this requirement is to be expected. To qualify for a student visa, you’re going to have to qualify as a student. This translates to: you’ll need to have successfully completed the required academic level to study further.

Academic entry requirements (besides evidence of English language skills) will vary depending on the course, level of education, and university you want to study at.
They vary from one university institution to the next. So, make sure you carefully read the course information (always the fine print!) on their website to see if you qualify.

A few tips for if you don’t qualify. You should sift through the internet to find a course/uni that will. OR, if you need to meet the requirements, and you really really really want that university and/or course, you should consider taking a Foundation or Bridging course. This is basically an intensive course that will help you meet entry requirements, usually lasting one year. And let’s be honest. One year is so doable if it’s that golden ticket to your dream exchange program.

Generally speaking, entry requirements for different levels of study include:

English language: Achieve the required English score.
Undergraduate: Have an overseas equivalent to an Australian Senior Secondary Certificate of Education. Some undergrad courses also have specific pre-requisite subjects.
Postgraduate: Have (satisfactorily) completed an undergraduate degree. Your institution may take research ability or relevant work experience into consideration so that’s always worth a shot.
Assuming you’ve ticked all these boxes and have confirmed enrolment with your university, you’ll be issued an electronic Confirmation of Enrolment (eCoE) certificate. If not, then make sure you heckle them for it! When you craft your application, don’t forget to attach your (eCoE) certificate!

3. FAILURE TO MEET ENGLISH REQUIREMENTS

Rule of thumb: If you’re planning to study in an English-speaking country, you’re going to have to speak English. This means that you’re going to have to meet the English language requirements to get your student visa approved.

For many applicants, you’ll have to provide your English language test results alongside your visa application. This condition is intended for international students exchanging from non-English speaking countries.

Now, not all language proficiencies are created equal. The English language skill required of you will vary from one university to the next. This can also vary from the skill level required for your student visa application. Make sure you check both the English requirements on the Department of Home Affairs and your university website to find out which English language level is required of you.

Either way, you’ll want to ace the IELTS or an equivalent test. What happens once you’ve improved your proficiency and achieved the required score? You’ve ticked off another box and are on your way to passing the biggest test: getting your visa approved!

Make sure you provide documentary evidence when you apply for your visa; evidence of an acceptable English language test score, and evidence that you fall within an exempt category for your university of choice.

4. YOU HAVE INSUFFICIENT FUNDS

You know the saying money doesn’t matter? Well it does if you want to buy a yacht. And it definitely does when it comes to getting your student visa approved. So if you’re planning to get that yacht, or in the nearer future that visa approved (assumedly a yes?), then you’re going to have to meet certain financial requirements.

And the government’s not going to take no for an answer. So, show them the money. Because money is one of the main reasons the Department of Immigration and Border Protection (DIBP) refuses applications.

The DIBP wants anyone applying for a student visa to prove their ability to finance their studies in Australia. So as an applicant you’ll have to make sure you can provide documents that prove your financial stability and ability to pay your way through your exchange.

So, what’ll it cost? What’s the damage? Currently, students must show credibility of an annual living expense of around $AUD20,000 but this is always subject to changes (typically in an upward direction).

For those of you aspiring students out there, you’re going to need documentary proof that prove you have this level of money to play with. Time to start saving folks. Because if you have insufficient funds in your bank account your student visa is going to be unceremoniously rejected.

As an international student, you will need to demonstrate proof of genuine access to the required funds for your exchange program in Australia. Some examples of how you can provide evidence of genuine access include:

Evidence that another person or business is providing funds, including evidence of your relationship, identity documents of the person providing said funds, or proof that the business is still operating. Imaginary friends and dead businesses can’t supply you with funds.
If you’re relying on a deposit, you will have to explain any recent and ongoing deposits (including wages).
If you have a tertiary loan to cover your tuition and/or living expenses, you should provide evidence of the terms and total amount of the loan that will be disbursed.
If you’re relying on some other type of loan you will need to show proof of collateral used, terms of agreement, and ability to cover ongoing costs. The best evidence of genuine access is full disbursement.

Immigrant agent relatively often involved in corruption

Agents, customs officers and military police with a migration background are relatively more involved in bribery and other integrity violations. They are particularly vulnerable, because criminals are relatively more often walking around in their usually extensive family and acquaintances circle who actively approach them. During screening of staff, insufficient attention was paid to their social origin.

This is what the Ministry of Security and Justice's Scientific Research and Documentation Center (WODC) writes in new research. This shows that law enforcement officers with a migration background in the police, customs, military police and FIOD are overrepresented in breaches of integrity. Within the police force, 40 percent of these cases involve someone with a migration background, while this group accounts for only 7 percent of the workforce. In absolute numbers, this concerns at least 19 cases among 4,500 agents with a migration background.\

Mark M.
In most cases, these are agents from 'basic teams' in the neighborhoods, who are under poor management. They are relatively young or at most middle-aged. Furthermore, around the turn of the century, the requirements were too low in the effort to attract people with a migration background. They did not always have sufficient qualities. This was compensated for with extra tutoring in a 'link class', but within the police it was soon given the name 'ethnic minority class'. According to the WODC, this did not promote integration into the force and "put them in a vulnerable situation."

The reason for investigating integrity issues is the case of Mark M., the 'police officer' who passed on confidential information to criminals. After a parliamentary debate on these and other corruption cases, the Minister of Security and Justice, then Ard van der Steur (VVD), requested scientific research.

The study reveals a total of 256 'signals' of serious integrity violations over the 2012-2016 period, of which more than 200 were reported to the police. Upon further investigation, 80 of them could be linked to organized crime.

Large social networks
Police staff accounted for the lion's share, which is partly explained by the fact that the police are the largest of the organizations investigated. Another explanation "lies in the fact that police officers operate more on the street and in the immediate vicinity of criminals." Furthermore, the reorganization means that the police are 'less far' than the other organizations with 'risk assessment and awareness of vulnerabilities'.

According to the WODC, the involvement of agents with a migration background is related to the large social networks in the family and acquaintances circle of which they are part. "Given the relatively high involvement of some ethnic groups in (organized) crime, the chance that officials with a migration background in their large network know someone from the criminal environment is greater than among native Dutch officials."

Another factor is that criminal organizations no longer shun the government. They seek active contact with law enforcement officers. Thieves with a migration background 'run an increased risk of being approached from organized crime'. Their double loyalty, to their social contacts and to the employer, is then put to the test.

The police leadership is aiming for a 25 percent influx of people with a 'diversity background' . That is difficult to realize, research by agency Motivaction showed earlier this week, because the police are of low regard to young people from that target group. Outgoing Minister Stef Blok (VVD) said this Tuesday in the House of Representatives that nevertheless the aim remains 'to give the police a more mixed composition, also with gays, lesbians and side entrants'.

Improvement:In an earlier version of this article it was stated that it concerned 30 cases among 4,500 agents with a migration background. That is incorrect. It concerns 19 cases. This error stems from the fact that the WOCD report deals with the integrity violations of all law enforcement organizations and not just the police. Of the 256 integrity violation signals at all law enforcement organizations, only a part can be legally proven. This concerns 47 cases with the police. Agents with a migration background are involved in 40% of these cases (19).
